It is a detailed investigation on the struggle between respecting the right of freedom of speech while honoring the protections of copyright in the digital age. This paper analyzes the historical beginnings of copyright, together with the Constitutional framers original intent as well as past and present case law to study the effect of the Digital Millennium Copyright Act on fair use and free speech as well as look ahead to what lies in the future.
